Dispute Resolution Process

THIS DISPUTE RESOLUTION PROCESS (THIS "DISPUTE RESOLUTION PROCESS") APPLIES TO YOUR PURCHASES OR SALES THROUGH THE APP OR THE WEBSITE (THE "SERVICES") PROVIDED BY BOXES INC. ("BOXES").

PLEASE READ THIS DISPUTE RESOLUTION PROCESS CAREFULLY.

BY USING THE APP OR THE WEBSITE, YOU ACKNOWLEDGE AND AGREE THAT: (I) YOU HAVE READ THIS DISPUTE RESOLUTION PROCESS; (II) YOU UNDERSTAND THIS DISPUTE RESOLUTION PROCESS; AND (III) YOU AGREE TO BE LEGALLY BOUND BY THIS DISPUTE RESOLUTION PROCESS. YOUR PURCHASES AND SALES THROUGH THE SERVICES AND YOUR USE OF THE SERVICES ARE ALSO GOVERNED BY THE TERMS OF SERVICE, TERMS OF SALE, PRIVACY POLICY AND BOXES CREDITS & REFER A FRIEND TERMS, THE TERMS OF WHICH ARE INCORPORATED BY REFERENCE IN THIS DISPUTE RESOLUTION PROCESS. CAPITALIZED TERMS USED AND NOT DEFINED IN THIS DISPUTE RESOLUTION PROCESS ARE DEFINED IN THE TERMS OF SERVICE.

IF YOU DO NOT AGREE WITH THIS DISPUTE RESOLUTION PROCESS IN ITS ENTIRETY, YOU MAY NOT PURCHASE OR SELL ITEMS THROUGH THE SERVICES.

THIS DISPUTE RESOLUTION PROCESS IS SUBJECT TO CHANGE AT ANY TIME AND IN BOXES' SOLE DISCRETION. ANY CHANGES WILL BE EFFECTIVE IMMEDIATELY UPON POSTING THE REVISED DISPUTE RESOLUTION PROCESS TO THE APP AND WEBSITE.

Sellers

If you are a seller, you cannot currently file a dispute through the Services. Please contact BOXES by emailing support@box.es if you have any questions or want to dispute a transaction.

BOXES Resolution Process

If a dispute has been filed by the Buyer through the Services within the 60 days of the applicable transaction date, BOXES will attempt to contact the buyer and the seller. A dispute cannot be filed with the Services after 60 days of the date of the applicable transaction date -- timeliness is important. To properly file a dispute, the filing party must provide BOXES a detailed description of the relevant facts of the dispute. BOXES will provide the counterparty to the dispute an opportunity to provide BOXES a detailed description of the relevant facts of the dispute as well. BOXES will not release the funds to either party to a dispute until BOXES determines, in its sole and absolute discretion, the extent to which the buyer and/or the seller should prevail in the dispute. Any such determination shall be final and binding and not subject to further appeal.

If BOXES determines to refund funds to a buyer and there are insufficient funds in its seller's account to cover the amount of such a refund, the seller's debit card or bank account, as the case may be, on file with BOXES will be charged. BOXES reserves the right to seek reimbursement from such seller if BOXES, in its sole discretion, provides a refund to a buyer, discovers erroneous transactions, or receives a chargeback from a buyer's credit card issuer. BOXES may also obtain reimbursement of any amounts owed by a seller to BOXES by deducting from future payments owed to such seller, crediting its account balance, charging its debit card or bank account on file with BOXES, or seeking such reimbursement from such seller by any other lawful means, including collections. Each seller authorize BOXES to use any or all of the foregoing methods to seek reimbursement, including charging of such seller's debit card or charging its checking account.

BOXES does not provide formal mediation services, collect payments, or force sellers to complete transactions. Either party to a transaction can also contact law enforcement in its area. BOXES will act in good faith to cooperate with any such investigation. Either party may also file a complaint with the Internet Crime Complaint Center.

Boxes Buyer Guarantee

We guarantee your money will be refunded if you make a purchase using the BOXES’ credit card payment system subject to the terms below. BOXES Buyer Guarantee applies when the item is not delivered or does not match the way it was described by the seller at the time of purchase. Before we refund your money you must attempt to resolve the problem with the seller and use our dispute resolution process. If we determine the problem was not caused by your actions, we will refund 100% of your purchase price as described below.

All transactions must require a delivery signature by the recipient to be eligible for BOXES Buyer Guarantee. For all transactions we encourage sellers to use a major shipping company which uses a tracking number and to insure its packages.

The buyer must file a dispute using the dispute resolution process if an item is not received within 14 days of the estimated delivery date; or 14 days after receiving the item. Otherwise, the BOXES Buyer Guarantee will not apply. BOXES reserves the right to extend the 14 day deadline in special circumstances.

BOXES Buyer Guarantee does not apply if the buyer opens a dispute with the buyer’s credit card company. Only one dispute resolution process can be selected by the buyer.

If we decide a refund is owed to the buyer, the funds will be withdrawn from the seller’s BOXES account. If the account has insufficient funds, the seller’s payment method on file will be used to collect the funds from the seller. In some unusual situations the seller will have no funds available. In those instances, we will not be able to refund the buyer’s money.

The refund will be credited to the buyer’s credit card or debit card on file.
